  • “The Court of Appeals specifically found it proper for the jury to decide fault independent of the damages phase, which is the critical concept behind this statute,” Cullefer said.
  • Cullefer is also the executive director of Georgians for Lawsuit Reform, and served as the lead lobbyist for the legal reform advocacy organization and worked on the tort reform bills, S.B. 68 and S.B. 69.
  • “Judicial interpretation of new statutory language is a normal component of the process,” he said. “There are and will likely continue to be questions at the margins — for example in this case, exactly how much injury detail belongs in the fault phase — as the courts continue to work through their initial interpretations of the law.”
