Another Alternative Retail Electric Supplier Enforcement Action Settles in Illinois

On June 4, Illinois Attorney General Kwame Raoul announced a settlement with Rushmore Energy, LLC, resolving allegations that the company violated the Illinois Consumer Fraud and Deceptive Business Practices Act. In addition to a $500,000 monetary payment, the consent order requires the company to suspend marketing activities and impose training policies and procedures.

Jennifer Davenport, New Jersey

Jennifer Davenport was appointed Attorney General (AG) of New Jersey on January 20, 2026. As the state’s chief law enforcement officer, she oversees the Department of Law and Public Safety and works with more than 42,000 state and local law enforcement officers and approximately 8,000 department employees. Her responsibilities include supervising criminal investigations and prosecutions, representing the state and its agencies in court, and enforcing New Jersey’s consumer protection and civil rights laws. In this role, she has focused on issues such as gun violence, human trafficking, and the safety and well-being of children, including from online threats.

Davenport brings extensive experience in public service and law enforcement. She previously served as New Jersey’s first assistant AG and principal law enforcement advisor and spent seven years as an assistant U.S. attorney for the District of New Jersey, including as chief of the General Crimes Unit. She has also held key positions with the U.S. Drug Enforcement Administration and the Waterfront Commission and has worked in both corporate and private practice, in addition to clerking for the U.S. District Court for the District of New Jersey.

Davenport is a graduate of DeSales University and Seton Hall University School of Law. She grew up in Cape May County and lives in Monmouth County with her two daughters.

  • Attorney General (AG) Jennifer Davenport and the New Jersey Bureau of Securities within the Division of Consumer Affairs announced that the bureau’s 2026 annual written examination of nearly 800 New Jersey‑registered investment adviser firms is underway, emphasizing scrutiny of firms’ use and marketing of artificial intelligence in portfolio construction and client recommendations, their cybersecurity and data‑protection policies, training and vendor oversight, and safeguards for vulnerable adults. The bureau warned that advisers must complete the online exam by June 30, 2026, or risk being deemed noncooperative under N.J.A.C. 13:47A‑14.16 and facing administrative action as the bureau works to identify emerging risks and strengthen investor protection.  
  • Davenport announced that the New Jersey Bureau of Securities within the Division of Consumer Affairs has filed a seven-count lawsuit in Superior Court in Mercer County against former Princeton resident Xiao “Mark” Hu and his companies Skyline Technology USA LLC and Thunderbirds.ME, Inc., alleging that they raised at least $2.5 million by offering and selling unregistered, fraudulent securities tied to purported technology and AI projects, defrauded at least 15 investors by misusing and commingling funds to finance Hu’s personal lifestyle, violated the New Jersey Uniform Securities Law, and seeking a permanent injunction barring them from the New Jersey securities business, civil penalties, restitution, and disgorgement (including from nominal defendants Jennifer Rong and Think Net, Inc.), while noting that Hu also faces related criminal securities fraud and other charges in a separate prosecution.  
  • Davenport announced that Gov. Mikie Sherrill has appointed veteran federal prosecutor Bernard J. Cooney of Montclair, NJ, to serve as the New Jersey insurance fraud prosecutor. Cooney brings extensive experience as an assistant U.S. attorney in the District of New Jersey, where he led the Health Care Fraud, Government Fraud, and Opioid Abuse Prevention and Enforcement Units, prosecuting complex health care fraud, False Claims Act, and Anti-Kickback Statute violations, as well as national security matters.
