New York AG Adopts Final Preclearance Rule and Prepares for the NYVRA to Take Effect

The New York Voting Rights Act‘s (NYVRA) preclearance section takes effect on September 22, 2024. The new rule requires covered jurisdictions to seek “preclearance” of certain covered policy changes to their election and redistricting procedures from the New York Office of the Attorney General (AG) or an appropriate court. The public comment period on the AG’s proposed preclearance rule is closed and resulted in the AG adopting the proposed rule as final without substantive changes. The final rule further clarifies the standards and processes for obtaining preclearance and will be published in the State Register on September 11, 2024.

Enzo Biochem Inc. Reaches Settlement With Connecticut, New Jersey, and New York AGs Over 2023 Data Breach

Molecular diagnostics company Enzo Biochem, Inc. has reached settlements resolving investigations in relation to a 2023 data breach by the attorneys general (AG) for Connecticut, New Jersey, and New York. Enzo has agreed to pay the states a total of $4.5 million, as well as institute and maintain new data security protocols.

AG Of the Week

Russell Coleman, Kentucky

On November 7, 2023, Russell Coleman was elected the 52nd attorney general (AG) of Kentucky, winning 117 out of 120 counties.

Before that, Coleman spent most of the past two decades in public service. In 2017, he was nominated by President Trump and unanimously confirmed by the Senate to be the U.S. attorney for the Western District of Kentucky. In that capacity, he was the chief federal law enforcement officer for Kentucky’s 53 western counties, ranging from Louisville to the Jackson Purchase Region.

Coleman previously served as a partner in the law firm of Frost, Brown, Todd; as a prosecutor in the Oldham Commonwealth’s Attorney’s office; and as legal counsel to U.S. Senator Mitch McConnell.

A former FBI special agent, he was assigned to multiple field offices, and served a temporary assignment in Iraq in support of the Global War on Terror.

Coleman was raised in Graves, Daviess, and Logan Counties, graduating from Logan County High School. He received both his undergraduate and law degrees from the University of Kentucky.

Russell lives in Oldham County with his wife, Ashley, and their three children.

Kentucky AG in the News

  • On September 5, Coleman announced that the U.S. Court of Appeals for the Sixth Circuit has blocked the Kentucky Registry of Election Finance’s attempt to restrict local county parties from expressing political opinions, following Coleman’s argument that such restrictions violated the First Amendment.

  • On September 4, Coleman issued legal guidance to Kentucky prosecutors and law enforcement regarding certain gaming machines.

  • On August 28, Coleman congratulated Matt Butler, who was appointed commonwealth’s attorney for the 47th Judicial Circuit in Letcher County by the governor following the retirement of Edison Banks, II.
