Josh has nearly two decades of experience representing companies in high-stakes class action litigation, government investigations, and business disputes. A partner in Troutman Pepper's Privacy + Cyber team and a Certified Information Privacy Professional, he has extensive experience in data breach litigation, having served as one of the court-appointed lead defense counsel for a cloud software company in one of the largest data breach multidistrict litigation proceedings in the U.S. Josh regularly litigates claims under numerous privacy laws, including the FCRA, the DPPA, and the California Consumer Privacy Act.
Josh also has deep knowledge of the financial services industry and regularly represents banks, mortgage companies, auto and credit card lenders, and other financial services industry clients facing complex litigation, mass arbitration, and government enforcement matters. He has a long and proven track record of achieving favorable outcomes in these matters, working with clients to identify the resolution that will best meet their business needs. Josh routinely handles significant litigation matters across the U.S., and has represented clients in governmental investigations and enforcement proceedings involving the Consumer Financial Protection Bureau, the Office of the Comptroller of the Currency, the Department of Justice, and state attorneys general. He further assists clients with internal investigations, responding to MRAs, developing and implementing remediation plans, and compliance programs.
Josh also has experience in data breach and cybersecurity litigation, and serves as one of the court-appointed lead defense counsel for a large cloud software company in multidistrict litigation proceedings.
Josh has significant experience in First Amendment matters, including representing religious organizations in litigation involving the Free Exercise Clause and Religious Freedom Restoration Act, defending media clients in defamation and intellectual property litigation, and counseling faith-based nonprofit organizations.
Josh is active in the community and has served as a board member of several local nonprofit organizations. He is committed to pro bono work and has represented clients in immigration matters, landlord-tenant disputes, custody and guardian ad litem proceedings, Criminal Justice Act appointments, and as amicus curiae in the U.S. Supreme Court.
