Julian Weiss

Julian is an associate in the firm’s Business Litigation practice who concentrates on commercial litigation, focusing on antitrust, international arbitration, and complex contract disputes. He has defended and pursued claims on behalf of a broad array of clients ranging from large public companies to individuals, including both public and private suits.

Julian advises companies on a broad range of antitrust issues including mergers, acquisitions and joint venture transactions before the U.S. Federal Trade Commission and the U.S. Department of Justice, litigation risk, responding to federal and state government investigations, and evolving commercial relationships. This experience includes horizontal and vertical competition issues, price fixing, market allocation, output restraints, monopolization, and exclusionary conduct.

Julian has an active pro bono practice. He has successfully represented clients in front of the Executive Office of Immigration Review and continues to advocate for immigrants seeking asylum. Julian also volunteers on the Election Protection’s voter hotline to help protect voter’s rights.

• Advised clients in preparation of pre-merger filings under the Hart-Scott-Rodino (HSR) Act with the Federal Trade Commission and Antitrust Division of the Department of Justice, and counseled clients through subsequent discussions with the reporting agencies, including issues in private equity, medical provider, insurance, oil and gas, aggregates, and cement markets.
• Obtained settlements on behalf of private lender who was defrauded in litigation filed in Eastern District of Pennsylvania.
• Obtained $14 million judgment in breach of contract suit against distributor in Eastern District of Pennsylvania and dismissal of counterclaims exceeding that amount.
• Represented a major medical device manufacturer in response to a second request under the HSR Act with the FTC.
• Represented a nonprofit in response to a second request under the HSR Act with the Antitrust Division.
• Represented a nonprofit hospital in response to information requested related to a merger under the Illinois Antitrust Act.
• Obtained summary judgment disposing of antitrust claims against a major energy utility in the Western District of North Carolina.
• Obtained $10 million judgment in suit against guarantor related to commercial properties in the Philadelphia Court of Common Pleas.
• Obtained declaratory judgment overturning a New York State election law for violation of the home rule clause of the state constitution in the Supreme Court of Onondaga County.
• Obtained dismissal of defamation claims against a journalist in the Eastern District of Pennsylvania.
• Obtained dismissal of securities fraud claims against a vaccine manufacturer in the Eastern District of Pennsylvania.
• Counseled clients on antitrust risks of new or existing lines of business, ventures, deals, or mergers.
• Counseled clients in response to subpoenas and information requests from Antitrust Division and FTC.
