Lindsey represents clients in high-stakes commercial litigation, including contract disputes, business torts, and environmental claims, with a special focus on class actions. Often, such litigation involves putative class claims that raise the potential risk and exposure exponentially. Lindsey takes a pragmatic approach and combines her thoughtful legal analysis, her experience in managing complex disputes, and her background in e-discovery to resolve these claims as quickly and as efficiently as possible.

Class Action Experience

  • Currently representing an installment lender in a series of putative class action cases related to claims asserted under the Unfair Competition Law and the California Consumer Legal Remedies Act.
  • Currently representing a major airline in defense of two putative class action cases related to claims under the Uniformed Services Employment and Reemployment Rights Act (USERRA).
  • Currently representing a large restaurant chain in defense of a putative class action case alleging violations of the Unfair Competition Law, California Consumer Legal Remedies Act, and False Advertising Law arising out of menu pricing for delivery orders.
  • Defeated class certification of claims for RICO violations, fraud, and negligent misrepresentation arising out of the filing of hospital liens on behalf of a nonprofit hospital system.
  • Defeated class certification of claims asserted under the Unfair Competition Law, California Consumer Legal Remedies Act, and False Advertising Law in two related cases on behalf of an e-cigarette manufacturer.
  • Obtained dismissal of putative class claims alleging RICO violations and various state law claims arising out of pharmaceutical company’s marketing and promotion of a prescription drug.
  • Obtained dismissal of putative class claims alleging deceptive acts or practices under Massachusetts, New York, and Pennsylvania statutory law relating to the sale of canned protein.
  • Represented a state-chartered bank in defense of multiple class actions involving claims for breach of contract, conversion, and usury arising out of the bank’s assessment of overdraft fees.

Environmental and Emerging Contaminants Experience

  • Currently serving as lead litigation counsel to a municipal utility operating a 10,000-acre land application system in defense of a Clean Water Act claim and various state-law tort claims arising out of alleged PFAS contamination.
  • Currently serving as lead litigation counsel to a private water utility seeking to recover treatment costs necessary to comply with stringent PFAS standards implemented in New York and New Jersey.
  • Obtained dismissal of putative class claims alleging nuisance, negligence, and trespass related to alleged groundwater contamination on behalf of an automotive parts manufacturer.
  • Obtained dismissal of tort claims related to air and groundwater emissions associated with coal-fired power plant.
  • Advised utilities in connection with permitting and litigation risks associated with closing ash ponds at various CCR units.
  • Represented a national utility in defense of a class action challenging the assessment of municipal franchise fees.
