State AGs Set Child-Safety and Privacy Expectations for Any Sale of Character.AI

By Troutman Pepper Locke State Attorneys General Team, Laura Hamady, and Shelby Dolen

State AGs are signaling that artificial intelligence (AI) chatbot user data will face scrutiny, even in bankruptcy. On October 14, a bipartisan coalition of AGs from 39 states and the District of Columbia filed a notice in the Chapter 11 case of Character Technologies, Inc. (Character.AI), outlining the child-safety and privacy protections they will press for in any sale. The notice comes just days before California announced a $6 million settlement with the successor to 23andMe, resolving claims over 23andMe’s 2023 data breach and ending California’s appeal of the 2025 bankruptcy sale of customers’ genetic data, the closest precedent for a Character.AI sale. AI companies, acquirers, and investors should take note.

AG of the Week

Dave Sunday, Pennsylvania

Dave Sunday was elected as Pennsylvania’s AG in November 2024, taking office in January 2025. Before running for AG, Sunday served as York County district attorney, a post he won in 2017 and held from January 2018 until becoming AG. Earlier in his career, Sunday prosecuted cases in the York County District Attorney’s Office and supervised its major crimes and narcotics units.

Sunday is a career litigator and has extensive felony jury trial experience. In 2013, Sunday was appointed as a special assistant U.S. attorney for the Middle District of Pennsylvania, where he assisted in prosecuting gang, illegal gun, and drug cases. During this time, he led the prosecution of Operation Sunrise, a large-scale multijurisdictional arrest and prosecution of more than 100 members and affiliates of the “Latin Kings,” a violent criminal gang operating in York County.

Beyond trial work, Sunday is a past president of the York County Bar Association and a former chair of the York Opioid Collaborative. He also chaired the Education and Training Committee of the Pennsylvania District Attorneys Association (PDAA).

After high school, Sunday joined the Navy as an enlisted recruit and was deployed to the Persian Gulf, where he participated in Operation Desert Strike. He was also deployed to South America, where he conducted numerous counter-narcotics operations in the Caribbean. After his military service, he received his undergraduate degree in finance from Penn State University in 2002 and graduated from Widener University Commonwealth Law School in 2007.

AG in the News

  • Sunday’s Antitrust Section, joined by New York’s AG, filed a complaint and proposed settlement in federal court to address competition concerns over Colas, Inc.’s planned acquisition of Suit-Kote Corporation, two leading Northeast producers of asphalt emulsions and pavement preservation services.
