Nicole focuses her practice on commercial litigation in a variety of areas, including complex business and contract disputes, insurance litigation, higher education law, class actions, data privacy and security law, gift cards and certificates, and construction and real estate law. She represents clients in cases throughout the U.S. in federal and state courts, as well as in mediations, arbitrations, and SEC investigations. Nicole represents clients in diverse industries, including financial and investment companies, educational institutions, product manufacturers, and information technology companies, among others.

Nicole is an active pro bono practitioner, having served as counsel in civil rights litigation on behalf of an inmate challenging the conditions of confinement and alleging constitutional violations. She is also a frequent participant in firm legal clinics.

Prior to joining the firm, she served as a law clerk to the Honorable Heidi W. Currier in the Appellate Division of the Superior Court of New Jersey. 

Complex Commercial Disputes

  • Representing an information technology company in an action involving misappropriation of trade secrets by former employees related to the formation of a competing business.
  • Defending a financial institution against breach of fiduciary duty and contract claims arising out of an estate dispute.
  • Defending major financial services advisory firm against breach of contract, negligence, and breach of fiduciary claims arising out of governmental investigation.

Higher Education Law and Class Action Litigation

  • Representing colleges and universities in putative class actions brought by students and parents seeking tuition and fee refunds related to the COVID-19 pandemic.
  • Counseling colleges, universities, and other educational institutions on compliance with the federal Clery Act, the Family Educational Rights and Privacy Act (FERPA), and other federal and state laws; policies and procedures dealing with Title IX of the amendments to the Higher Education Act; and on student conduct policies and proceedings and corporate governance disputes.
  • Defending private university in employment discrimination action.

Insurance

  • Representing leading national insurers in bad faith actions challenging their claims handling practices.
  • Representing national insurer and government sub-contractor in personal injury action alleging negligence and statutory violations.
  • Advising on complex coverage issues.

Data Privacy and Security

  • Counseling clients on data privacy and security protocols and safeguards.
  • Advising clients on data breach reporting and notification obligations under federal, state, and international laws.
