- CCPA applies not only to businesses located in California, but to any business that collects California residents’ “personal information” and meets the CCPA’s threshold requirements.
- Relevant to payment processors and banks, these types of entities are not exempt from the act, although they may be able to leverage certain exceptions (e.g., the carve out for GLBA data).
- CCPA enforcement officially began July 1, 2020. Certain organizations have already received “Notice and Cure” letters from the California Attorney General for alleged non-compliance. Penalties for non-compliance are steep, ranging $2,500 to $7,500 for each violation.

This session will address these questions by exploring the facts presented in a multi-part hypothetical which mirrors various stages of the solicitation process. The recent opinion by the American Bar Association Standing Committee on Ethics and Professional Responsibility also suggestions to mitigate the risks of dealing with prospective clients.
