While in Keodalah the plaintiff’s attorney compared suing a claims adjuster to the ability to sue a truck driver personally for an accident, Samrah Mahmoud, partner in the Orange County office of Troutman Pepper Hamilton Sanders LLP, said that argument misses the point.

“Hopefully the number of accidents that a truck driver has throughout his career are minimal, whereas [a ruling for the plaintiff in Skillett] could subject a claims adjuster to a potential lawsuit anytime they denied a claim in Colorado,” she said. “Obviously with attorneys and doctors, you’d expect that individual liability malpractice … but it seems like an unprecedented move here. It would definitely chill the number of people who would be willing to sign up for that kind of job.”
