Brendan O'Regan

Brendan assists in the representation of for-profit and nonprofit developers in substantial rehabilitation, including low income housing tax credits (LIHTC), with and without tax-exempt bonds; developers and owners in Section 202 redevelopment, prepayments and senior preservation rental assistance contracts, Mark-to-Market restructurings and qualified nonprofit debt forgiveness; Flexible Subsidy deferrals; and Section 8 renewals, modifications, and assignments.

Brendan counsels clients in administrative appeals of HUD’s Real Estate Assessment Center physical inspection protocol (REAC), Management and Occupancy Review program (MOR), and 2530 previous participation “flags.” He also has extensive experience in advising on organizational structuring and technical issues concerning HUD’s Previous Participation APPS electronic and paper filings; providing representation involving HUD’s Departmental Enforcement Center (DEC) penalty and regulatory actions; and counseling property management agents for HUD approval and ongoing compliance requirements.
