Kathleen assists clients in a wide variety of state and federal commercial litigation, arbitration, appellate, and regulatory matters across several industries, including construction, energy, renewable energy, and information technology.

Kathleen’s experience includes pre-trial strategy and investigation through trial or arbitration, as well as appeal. She has experience in managing complex discovery, including drafting and responding to discovery motions; assisting in a variety of appellate matters, including drafting related briefs; drafting and responding to dispositive motions; leading post-judgment collections proceedings; assisting in international arbitration proceedings; and crafting regulatory testimony, including in the renewable energy sector.

  • Assisted with the representation of a major liquified natural gas company in an international arbitration dispute and related proceedings governed by the International Chamber of Commerce regarding long-term gas delivery and a tolling agreement.
  • Assisted with the representation of property owners in a residential construction defect dispute with a large luxury homebuilder, secured and defended lis pendens on related developer properties.
  • Assisted with the representation of a large construction company in cybersecurity litigation in state and federal court.
  • Assisted with ERISA benefits litigation in federal court.
  • Served as lead counsel in commercial lease disputes for a mid-sized property owner.
  • Assisted with the representation of a commercial property owner in a suit to foreclose mechanics lien, and helped secure a new trial.
  • Assisted with the representation of a major natural gas seller in a dispute with one of the largest gas producers regarding the delivery of gas during Winter Storm Uri.
  • Assisted with the representation of power generator companies in multidistrict litigation concerning Winter Storm Uri.
  • Assisted with the representation of a major pipeline in a Federal Energy Regulatory Commission intervention regarding propane delivery and rates.
  • Assisted with the representation and appeal related to standing in election contests under the Texas Election Code.
  • Secured release of mechanics liens and FAA lien while assisting with representation of property owners.
