Mark represents a diverse range of clients, including developers, purchasers, and sellers of power generation facilities, as well as purchasers and sellers of electricity and natural gas, in both wholesale and retail markets. His experience also includes a broad variety of commercial transaction matters.

  • Representing the owner of an ethanol manufacturing plant in connection with the conversion and decarbonization of the plant to produce green ethanol, including equipment supply agreements, EPG agreements, wing power purchase agreements, and carbon capture transportation and sequestration agreements.
  • Represented a private equity-backed portfolio company in connection with the development of dairy-based renewable natural gas projects in Ohio and Oregon, including the negotiation of ground leases, manure supply agreements, EPC contracts, and RNG offtake agreements.
  • Represented a developer in land acquisition matters for a proposed hydrogen production facility.
  • Counseled a developer with the development and sale of three Texas-based battery storage projects, including the acquisition of land rights, preparation and negotiation of project development contracts, and negotiation of purchase and sale agreements for the sale of such projects.
  • Represented the developer of a 51-megawatt natural gas-fueled peaking power generation project in Texas, negotiating power purchase agreements, equipment purchase agreements, EPC contract, and project financing documents.
  • Counseled the developer of a cogeneration project in Texas, negotiating energy services agreements, equipment purchase agreements, EPC contract, and site lease.
  • Assisted a major U.S. power company in expanding its Deer Park and Channel Energy Centers by approximately 260 megawatts each, including turbine refurbishment contracts and EPC contracts.
