Lenders trust us to handle their most complex financing structures for assisted living, memory care, skilled nursing, continuing care retirement communities (CCRCs), and independent living facilities. Our team represents national and regional banks as well as nonbank lenders across the full spectrum of transactions, including construction, bridge, term, and asset-based revolving loans, acquisition financing, and operating lines of credit. We are involved with transactions involving borrowers such as publicly traded and privately held companies, nonprofit borrowers, and individual owners of senior housing and skilled nursing facilities.
Our team is broadly experienced across all types of lending structures and credit facilities, including loans secured by senior housing properties in multiple states using a borrowing base structure. We routinely assist our lender clients with structuring senior debt facilities to accommodate mezzanine and/or junior lien financing, and we have worked closely with clients to negotiate intercreditor agreements with a variety of subordinate lenders. Our attorneys are also experienced in structuring transactions to comply with Islamic law and to accommodate the use of master leases in borrower joint ventures with pension funds.
Clients benefit from our seamless and comprehensive approach, which incorporates the capabilities of our nationally recognized Multifamily Housing Finance Group to coordinate our balance sheet lending work with the market expectations of Fannie Mae and Freddie Mac. The firm’s dedicated health care attorneys also advise our lender clients on the federal and state regulatory issues faced by their customers.
Our experience extends to representing lenders with loan workouts involving distressed health care assets, as well as debtor-in-possession financing.
